Seller Terms

AYRVANA is owned & operated by Damerax Cloud Solutions (MSME Registered, Hyderabad, India). Every boutique, seller, admin user, uploader, or agency using AYRVANA is responsible for the legality, accuracy, rights clearance, and safety of all content and products they upload or offer.

1. Seller Responsibility

Sellers are solely responsible for boutique information, product listings, prices, offers, measurements, fabrics, images, AI-generated visuals, claims, customer communication, order fulfilment, payments, taxes, invoices, shipping, returns, exchanges, refunds, complaints, and legal compliance.

2. Image, AI, and Model Rights

Before uploading any image, seller must ensure that it has all required rights, permissions, consents, licences, model releases, publicity rights, privacy permissions, copyright permissions, trademark permissions, and design permissions. This applies to photographs, catalogue images, customer photos, model images, social media images, AI-generated images, edited images, mockups, and reference images.

• Seller must not upload a real person's image or likeness without lawful permission where required.
• Seller must not create or upload AI images that impersonate, imitate, exploit, or misleadingly resemble a living person, celebrity, influencer, public figure, private person, or competitor.
• Seller must not upload copyrighted images, brand images, designer references, logos, or third-party catalogue photos unless authorised.
• Seller must clearly avoid misleading buyers about whether an image is a sample, AI visual, catalogue reference, or actual finished product.

3. Product and Service Accuracy

Seller must ensure all listings are truthful and not misleading. Stock, customisation, delivery times, fabric, embroidery, finishing, sizing, pricing, cancellation, and refund terms must be communicated clearly to buyers before payment.

4. Prohibited Seller Content

Sellers must not upload illegal, obscene, defamatory, discriminatory, harmful, infringing, fake, misleading, impersonating, privacy-invasive, unsafe, or unauthorised content. AYRVANA may remove content or suspend seller access without prior notice if risk is detected.

5. Subscription and Visibility

Seller visibility depends on approved onboarding, active subscription status, platform review, and operational compliance. AYRVANA does not guarantee leads, sales, ranking, traffic, campaign placement, or buyer conversion.

6. Payment and Plan Fees

Seller plan fees, maintenance fees, launch offers, and benefits may change. Payment gateway charges, taxes, bank charges, and third-party fees may apply. Activation may require payment confirmation and verification. Unless stated in writing, seller subscription fees are paid for access and digital services, not for guaranteed sales.

7. Indemnity by Seller

Seller agrees to indemnify and hold AYRVANA and Damerax Cloud Solutions harmless from all claims, legal notices, takedown requests, image-right disputes, likeness claims, copyright claims, trademark claims, privacy claims, buyer disputes, delivery disputes, tax claims, penalties, losses, damages, legal costs, and expenses caused by seller content, products, conduct, or breach of these Terms.

8. Audit, Removal, and Suspension

AYRVANA may request source files, ownership proof, invoice proof, consent proof, model release proof, licence proof, or product details. Failure to provide satisfactory proof may result in content removal, plan suspension, or account termination.
